Distance Sales Agreement
Contents · 10 sections
This agreement sets out the rights and obligations of the parties for orders placed electronically at the KodStore store (https://kodstore.com) under Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. This English text is provided for convenience; in case of any inconsistency the Turkish version prevails.
1. Parties
Seller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. The sale is concluded between the Buyer and Paddle; for Türkiye and most other countries the seller is Paddle.com Market Limited (30 Old Bailey, London EC4M 7AU, United Kingdom; contact: paddle.net). Payment, tax, invoicing and refunds are governed by Paddle's Buyer Terms.
Product provider
The product is supplied, licensed and delivered by Oğuzhan Şahin, operator of KodStore (the "Provider"; email: info@kodstore.com). The provisions of this agreement on the product's features, delivery, licence, the effect of a refund on the licence and defective performance apply between the Buyer and the Provider.
Buyer
The person who enters their billing details at checkout and places the order (the "Buyer"). The Buyer's name, email address, phone and billing address are stored with the order.
2. Subject
The subject of this agreement is the sale of a usage licence for the digital products in the Buyer's order (intangible goods such as software, scripts, plugins, themes and documentation) and their electronic delivery. The name, quantity and price including taxes of the products and the total are stated in the order and form an integral part of this agreement.
3. Price and payment
Prices include taxes; no delivery fee is charged. Payment is taken in Paddle's checkout window with the methods Paddle offers (such as cards); card details never reach the Provider. Tax is calculated within the total according to the Buyer's country, and Paddle issues the invoice. An order whose payment is not completed is not binding.
4. Delivery
There is no physical delivery. When Paddle confirms the payment, the product files become available under "Downloads" in the Buyer's account; delivery takes place at that moment. Delivery will not take longer than 30 days after the payment is confirmed.
5. Right of withdrawal and refunds
Under Article 15(1)(ğ) of the Regulation on Distance Contracts, the statutory right of withdrawal does not apply to intangible goods delivered to the consumer instantly. Using the option the same article allows, the Provider nevertheless grants the Buyer the right to request a refund without giving a reason within 14 days of the purchase date; refunds are issued by Paddle. How to request it, cases of abuse and other conditions are set out in the Refund Policy, which forms part of this agreement. A refund ends the product licence and closes access to the files; the Buyer must delete every copy of the product and stop using it.
6. Defective performance
If the delivered product does not match the features stated on the product page at the time of the order, the Buyer may exercise the remedies under Article 11 of Law No. 6502 (withdrawal from the contract, price reduction, free repair or replacement). Claims are sent in writing to info@kodstore.com. The scope of updates and support is set out in the Terms of Use and on the product page.
7. Licence
The purchased product is used under the single-business licence defined in the Terms of Use. Reselling, redistributing or sublicensing the product or its source code is prohibited. The licence ends with a refund of the order or with a chargeback decided in the Buyer's favour; while a chargeback is open, the licence and download access may be suspended.
8. Personal data
The Buyer's personal data is processed as described in the Privacy Policy.
9. Disputes
For disputes arising from this agreement the Buyer may apply to the Consumer Arbitration Committee at their place of residence or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Courts above those limits.
10. Entry into force
The agreement is concluded when the Buyer confirms at checkout that they have read the pre-information form and accept this agreement, and places the order. An order summary is sent to the Buyer's email address; the order details are always available under My account › Orders and the text of this agreement on this page.
